Por eso, analizamos los datos y la legislaci\u00f3n detr\u00e1s del asfalto.<\/p><hr \/><h3>1. \u00bfQui\u00e9n es el titular de la v\u00eda? La responsabilidad legal<\/h3><p>Cuando pasas por un bache que pone en riesgo tu integridad, lo primero que debes saber es que <strong>la DGT no pone el asfalto<\/strong>.<\/p><p>La responsabilidad recae sobre el <strong>titular de la v\u00eda<\/strong>, que seg\u00fan la <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-10439\">Ley de Carreteras<\/a><\/span>, tiene la obligaci\u00f3n legal de mantenerla en condiciones de seguridad y servicio.<\/p><p>Para saber a qui\u00e9n reclamar o qui\u00e9n es el responsable, f\u00edjate en la nomenclatura:<\/p><ul><li><strong>Estado (Ministerio de Transportes):<\/strong> Carreteras con prefijo <strong>A, AP o N<\/strong> (nacionales y autov\u00edas estatales).<\/li><\/ul><ul><li><strong>Comunidades Aut\u00f3nomas:<\/strong> Carreteras con prefijos regionales (<strong>M, A, AS, CV<\/strong>, etc.).<\/li><\/ul><ul><li><strong>Ayuntamientos:<\/strong> V\u00edas urbanas y traves\u00edas dentro del casco urbano.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ef19865 e-grid e-con-boxed e-con e-parent\" titular de la v\u00eda no solo pone el nombre a la carretera; debe garantizar que el <strong>principio de informaci\u00f3n<\/strong> y seguridad est\u00e9 vigente. Esto incluye:<\/p><ol><li><strong>Estado del firme:<\/strong> Evitar baches peligrosos y grietas que afecten a la adherencia.<\/li><li><strong>Se\u00f1alizaci\u00f3n:<\/strong> Tanto vertical como horizontal (pintura) en perfecto estado.<\/li><li><strong>Elementos de protecci\u00f3n:<\/strong> Barreras de seguridad y quitamiedos operativos.<\/li><li><strong>Vialidad y drenaje:<\/strong> Evitar charcos peligrosos y asegurar la limpieza en caso de nieve o hielo.<\/li><\/ol><hr \/><h3>3. Esto genera un <strong>deterioro sist\u00e9mico<\/strong> inevitable.<\/p><\/blockquote><hr \/><h2>4. \u00bfFalta de dinero o de prioridad?<\/h2><p>Muchos conductores se preguntan si pagamos suficientes impuestos para tener carreteras seguras. La respuesta corta es s\u00ed.
